This Tuesday, President Trump will make his first Oval Office address for the year. It will air on all the major networks at 9PM EST, and the President will stress the humanitarian concerns at the southern border. Although he has threatened declaring a national emergency, insiders state that was not in the draft for the speech this morning. He is standing firm on the partial shutdown until his demands for wall funding are met. He will follow this up with visiting the U.S.-Mexico border Thursday.
Rebuttals After the Speech
House Speaker Pelosi and Senate Minority Leader Schumer will air rebuttals following the President’s remarks. Both have repeatedly called on President Trump to reopen the closed parts of government while they continue to negotiate. In this vein, the major networks that are airing the President’s speech will also air the rebuttals.
Critics on “crisis”
Critics are claiming the crisis point the Trump Administration is pushing is overblown and state that illegal crossings have decreased to less than 400,000 last year. What is increasing is the amount of families that are attempting to cross the boarder and seek asylum, which is placing an even bigger strain on the immigration system than before.
To get ahead of Pelosi passing individual bills, one of which will pay out tax refunds, the White House declared the refunds would be paid regardless of the shutdown. Pelosi’s other bills will propose opening the Treasury Department and other federal agencies.
Democrats have said his declaring a national emergency would be an illegal overreach of the President’s powers. However, he is within his powers to declare one. The issue at hand is the White House has not clearly explained any legal justification for the declaration, which is an issue. As many have pointed out, the caravans at the border are not conventionally armed nor are they an organized military force. They have, under certain circumstances, thrown rocks, bottles, and sticks at border patrol agents as well as placed women and children in the line of fire when tear gas has been deployed. This means they pose no real military threat. So, what WOULD be the legal reason for declaring a national emergency?
