On May 15, The American Civil Liberties Union and Planned Parenthood put forth a lawsuit against Ohio HB258, otherwise known as the Ohio “heartbeat” bill. The bill makes having an abortion performed after six weeks. This is before a woman discovers she is pregnant, is unconstitutional.
They contend it is in direct conflict with Roe v. Wade, a Supreme Court decision that set the precedent fetal viability -24 to25 weeks- is the benchmark for legal abortions. The lawsuit was filed in hopes a ban will be placed upon the bill to allow a federal judge to weigh on the matter.
The HB 258 will become law on July 10, 2019. The bill also does not have exemptions for rape or incest.
